Terms and Conditions of Trading

  1. These standard terms and conditions of trading apply to all sales made and services supplied by us and to all agreements entered into by us unless they, or any term contained in them, are expressly excluded by any other written agreement between the parties and signed by both of them. No amendment or alteration shall be effective unless made in writing and signed by both of the parties.
  2. Payment is required by way of cash with order and prior to delivery unless otherwise agreed in writing
  3. All list prices are subject to alteration without notice. Goods are invoiced at prices ruling at the date of despatch and services are invoiced at the date the last service is performed and orders are deemed to be placed and accepted on this basis.
  4. All prices are exclusive of VAT which shall be applied at the rate applicable at the date the invoice is rendered.
  5. Carriage, posting and packing are charged at cost.
  6. Estimated delivery dates are those dates on which we expect in good faith that goods will be available and delivered to the customer and estimated service dates are those on which we expect in good faith that services will be performed for the customer. However time is not of the essence of the agreement and we shall not be liable in any manner whatsoever for any losses arising in the event that goods are not delivered or services are not performed on the date that we have estimated or at all and in the event of non-delivery or non-performance our obligation and liability shall be limited to the refund of any monies prepaid by the customer.
  7. Any claims relating to defective goods or to damage in transit must be notified to us in writing and such written notice must be received by us not later than 23.59 hours on the third day following delivery. Any claims relating to defective services must be notified to us in writing and such written notice must be received by us not later than 23.59 hours on the seventh day following delivery. In no event shall we be liable in any manner whatsoever for any losses arising in the event that goods are defective or damaged in transit and in the event that goods are defective or damaged in transit our obligation and liability shall be limited to the refund of any monies prepaid by the customer.
  8. Any claims of non-delivery of goods must be notified to us in writing and such written notice must be received by us not later than 23.59 hours on the seventh day following the sending by us of the invoice or delivery note relating to them. Goods claimed not to be in accordance with the order must be retained as delivered for inspection by us and upon request by us and the tender by us of the proper cost of their return must be returned to us for inspection. In the event of any failure to adhere to any of these requirements any liability on our part shall cease.
  9. In the event that any supply of goods and services is made by us other than to an end-user or consumer the purchaser shall be solely responsible for ascertaining that the goods or services supplied by us are reasonably suitable for the purpose intended or required by the enduser and shall indemnify us fully in respect of any claim which may be made against us by such end-user.
  10. Title to all goods supplied by us (including goods or materials fitted or supplied in the course of services rendered by us) shall be retained by us until such time as the cost of those goods and services (as the case may be) shall have been paid to us in full and in the event that payment shall be made by cheque or any negotiable instrument title to such goods shall not pass until such cheque or negotiable instrument has been cleared by the paying bank. Until title has passed in accordance with this condition we shall be at liberty to take possession of any goods supplied at our sole discretion and the customer hereby irrevocably authorises us to have access to the location of such goods in order to take possession of them.
  11. All statements, conditions or warranties whether express or implied by law or otherwise as to the quality of any goods ordered or supplied or of services rendered or the fitness of such goods for any purpose are expressly excluded to the extent permitted by law.
